From the moment the purchaser accesses the www.latravaglina.it website, he/she agrees to comply with the terms and conditions set out below, including all the documents listed. Users are invited to examine this document carefully before using the services.

Object of this contract

The purpose of this contract is the purchase and sale of bottled wines and accessories in the quantity and quality chosen by the consumer through product selection on the www.latravaglina.it website. The goods and services for sale are those described on the pages of www.latravaglina.it. The data indicated therein may be subject to change and periodic updating, also for the purpose of further improving the service for the customer.

Purchase contracts made by minors

In compliance with the laws in force regarding the purchase of wines and spirits, La Travaglina S.r.l. reserves the right not to process orders from persons who do not respect the age limits set by law for both the purchase and delivery of wines and spirits. In particular, La Travaglina S.r.l. does not sell wines to persons under eighteen years of age. By using the Site, the purchaser guarantees that he/she is over the age of eighteen and that the person who will receive the shipment is also over the age of eighteen.
La Travaglina S.r.l. is exempt from any liability in the event of a purchase by a person under the age of eighteen who has provided false information relating to age or false information in order to purchase the goods and/or to access the data on the site.

Product prices and availability

Product prices are indicated on the site and are inclusive of VAT. To the price of the product must be added the cost of shipping where applicable, the amount of which, also indicated on the site, varies depending on the delivery method requested, in addition to any customs duties. In the event that the product is not available, the customer will be promptly informed by e-mail. The prices and availability of products sold by La Travaglina S.r.l. through the site www.latravaglina.it are subject to change without notice.

Delivery of goods

The delivery of goods takes place according to the terms indicated on the site, to the address indicated and by the courier appointed by La Travaglina S.r.l. In order to avoid fraud, the courier reserves the right to check an identity document, which proves the coincidence between the order information and the credit card holder. Please note that, for a more efficient delivery of the goods, La Travaglina S.r.l. will communicate to the courier the telephone number provided during registration on the website www.latravaglina.it or at the time of the order. This telephone number will be used in compliance with the privacy regulations set out in Legislative Decree no. 196/2003. Before making the delivery, the courier will contact the addressee of the goods by telephone at the aforementioned telephone number in order to agree on the day and time scheduled for delivery. The purchaser, upon receipt of the goods, is required to check their integrity and compliance with the order placed in the presence of the delivery agent. If the packaging of the shipment is damaged, the consumer must ACCEPT the package and note this damage on the waybill/transport document. If the package is undamaged, the consumer must accept it and may also sign the delivery receipt with the wording ‘I ACCEPT WITH RESERVE OF CHECK’. In the event that one or more products are damaged or do not correspond to the order placed, the purchaser, only if he/she has previously noted the damage on the consignment note/document of transport or has accepted subject to control, must inform La Travaglina S.r.l. by email within 3 (three) working days of delivery at . Soc. Agricola at info@latravaglina.it also providing documentation, including photographs, of the damage or incorrect delivery, the proof of which is the responsibility of the consumer. La Travaglina S.r.l. reserves the right to request the return of damaged/erroneous goods at the expense of the consumer, which must be dispatched within 15 days of La Travaglina S.r.l.’s request, failing which the right to replacement or refund will be forfeited. Once La Travaglina S.r.l. has ascertained the existence of the damage or faulty delivery, it will, at its own expense, within and no later than 30 days from the date of delivery or notification, replace the damaged/erroneous products or, if this is not possible, refund the purchaser the amount due. Should the customer contact Customer Service after the third working day, La Travaglina S.r.l. will decide to open a file in order to replace the damaged/wrong goods.

Delivery time

Delivery of goods may take between 3 and 5 working days, excluding islands or areas that are difficult to reach, for which longer delivery times may be required. The delivery times indicated are not binding and may be subject to variations beyond the control of La Travaglina S.r.l.

Right of Withdrawal

The customer may exercise the right of withdrawal within and no later than 14 working days from the date of receipt of the goods. This right must be exercised by sending a registered letter with acknowledgement of receipt to the headquarters of La Travaglina S.r.l., located in Via Cascina Travaglina, 1, 27046 Santa Giuletta (PV). The communication may also be anticipated, within the same term, by email to the address info@latravaglina.it, provided that it is confirmed by registered letter with acknowledgement of receipt within the following forty-eight (48) hours. The goods must be returned to La Travaglina S.r.l. intact, in unaltered condition and complete with the original packaging, at the expense of the consumer within and no later than 15 days from the communication of withdrawal. La Travaglina S.r.l. will refund the sums paid within a maximum of 30 days from the date of receipt of the registered letter and in any case not before having received the goods and checked the condition of the goods subject to withdrawal. The costs and risks associated with returning the products will be borne by the consumer. It should be noted that Community legislation provides that the right of withdrawal can be exercised only by natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, CANNOT be exercised by legal persons and natural persons who act for purposes related to a commercial activity. Purchases made by retailers or by persons who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal. The right of withdrawal does not apply to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or alter rapidly. It is also specified that, in the case of prize operations (so-called promotions), in which the purchase of a good is combined with another good that is sold at a negligible price or even given away, the right of withdrawal will be legitimately exercised with the return of both goods purchased, given the constraint of the accessory nature of the good in promotion with respect to the first.

Limitation of liability

La Travaglina S.r.l. assumes no responsibility for any damage resulting from the use or incorrect use of the service provided by the site www.latravaglina.it. La Travaglina S.r.l. assumes no responsibility for errors and omissions within www.latravaglina.it or any website to which reference or connection may be made. La Travaglina S.r.l. reserves the right to continuously update the site www.latravaglina.it which can be done at any time. The information may contain inaccuracies of any kind or typing errors. La Travaglina S.r.l. does not guarantee that the services provided by www.latravaglina.it will be provided without interruptions, this will be stated in advance except for causes beyond the control of La Travaglina S.r.l.. La Travaglina S.r.l. declines any liability towards the buyer or third parties for direct or indirect damages (including, by way of example, loss of profits, revenues, business opportunities) arising from or in relation to a product or service supplied by La Travaglina S.r.l., or from the use or inability to use the same. La Travaglina S.r.l. assumes no liability for disruptions attributable to unforeseeable circumstances or force majeure, such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that may prevent, in whole or in part, the execution of the contract within the agreed timeframes. La Travaglina S.r.l. will not be liable for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above, with the buyer only being entitled to a refund of the price paid. Except in the case of fraud or gross negligence, the right to compensation against La Travaglina S.r.l. may not exceed the price of the products purchased by the consumer and for which the dispute arose.

User/consumer responsibility

The user is required to ensure that the data entered is true, complete, updated and to promptly communicate any changes to the same. In the event that false declarations are made, La Travaglina S.r.l. reserves the right to exclude such subjects from its user lists, after a formal and unaccepted invitation to self-correction.

Payment methods

Payments in execution of purchase contracts stipulated through the site may be made exclusively by credit card, PayPal.
Purchases by credit card are made through the PayPal channel.

The amount of the order is charged to the current account connected to the credit card at the time of order confirmation.
In the event of cancellation, the amount is refunded to the current account connected to the Customer’s credit card.

In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the PayPal login page. The amount relating to the order is charged to the PayPal account at the time of acquisition of the order. In case of cancellation of the order, either by the Customer or in the case of non-acceptance by La Travaglina S.r.l., the amount will be refunded to the customer’s PayPal account. In case of cancellation of the transaction, under no circumstances can La Travaglina S.r.l. be held responsible for any damages, direct or indirect, caused by a delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure is La Travaglina S.r.l. able to know the Customer’s financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of La Travaglina S.r.l. contains or stores such data. For each transaction carried out with the PayPal account the Customer will receive a confirmation email from PayPal.
